President of Kazakhstan Tokayev ratified the CIS Trademark Agreement

On 19 June 2023, the President of the Republic of Kazakhstan Kassym-Jomart Tokayev signed a law on the ratification by the Republic of Kazakhstan of the Agreement on Cooperation of the CIS Member States in Preventing and Combating the Use of False Trademarks and Geographical Indications.
The main purpose of this Agreement, signed on 28 May 2021 at a meeting of the Council of Heads of Government of the Commonwealth of Independent States, is to develop cooperation between the parties. Its purpose is to prevent, detect and suppress the production and sale of goods with false trademarks and geographical indications, as well as to solve the problem of transferring such goods across the borders of the CIS member states.
By ratifying this agreement, Kazakhstan takes a significant step in joining efforts with other CIS countries to protect intellectual property rights. The focus of the agreement is joint measures to exchange essential information on the production and sale of goods bearing false trademarks and geographical indications. In addition, the parties undertake obligations to train and improve the qualifications of personnel responsible for the protection and enforcement of intellectual property rights. Notably, the Agreement emphasises the parties' general obligations to apply remedies to prevent the use of deceptive means in the designation of origin and properties of goods. The parties also undertake to combat unfair competition by refusing to register false trademarks and geographical indications or invalidating such registrations.
A number of CIS countries, including Armenia, Belarus, Kyrgyzstan, Tajikistan and Uzbekistan, have successfully completed the necessary domestic procedures under the agreement.
